Samsung ordered to pay Apple $539m over patent breach

Mubasher: Samsung was ordered by the US district court in California to pay a total of $539 million to Apple over patent infringements, bringing the seven-year legal battle to its final chapters.

The case goes back to 2011 when Apple accused Samsung of copying design features from its products.

The jury found on Wednesday that the South Korean company should pay the iPhone maker $533.3 million for infringing three design patents in addition to $5.3 million for violating two utility patents.

“Today’s decision flies in the face of a unanimous Supreme Court ruling in favour of Samsung on the scope of design patent damages,” Samsung said in a statement.

The Seoul-headquartered firm argued that the amount should only be $28 million for patent damages, limiting the amount to profits directly related to the components and features covered by the patents.

Meanwhile, the California-based technology giant went for more than the $1 billion it received in the earlier trial and which was later reduced by appeals courts.

The South Korean company appealed a court decision in which Apple was awarded $1.049 billion in 2012, culminating in a Supreme Court ruling in 2016 stating that patent damages should be based on the infringed components not the entire iPhone.

The Supreme Court decision failed to provide a precise guidance as to how patent damages should be calculated.

Later on, many product designers have filed briefs with the court which stipulated that the product and its design are an indivisible whole.
